These Terms and Conditions govern the use of the AtacamaStargazing website, the booking of our astronomy tours in San Pedro de Atacama, and the online payment of reservations. By accessing the site or making a booking, you fully accept these terms. If you do not agree with any of them, please do not use the site or contract our services.

2. Acceptance of the terms

By browsing this site, completing a booking, or making a payment, you declare that you have read, understood, and accepted these Terms and Conditions, as well as our Privacy Policy and our Cancellation Policy, which form an integral part of this agreement.

3. Use of the website and cookies

You may access and use the content of this site for your personal use. Copying, republishing, selling, sublicensing, or redistributing the site's material without express authorization is not permitted.

We use cookies that are necessary for the site to work correctly, plus optional cookies for statistics and measurement. Details of which data we process and with which tools (Google Analytics 4, Google Tag Manager, Microsoft Clarity) are set out in our Privacy Policy.

4. Intellectual property

Unless otherwise stated, AtacamaStargazing and/or its licensors own all intellectual property rights in the material available on this site (text, images, brand, and content). All rights are reserved. The AtacamaStargazing logo and illustrations may not be used without a specific license agreement.

5. Booking and contracting tours

Bookings are completed in our online booking system, hosted at book.atacamastargazing.com, which you reach from the booking buttons on this site. When you book, you must provide the date and time slot, the number and category of passengers, the pickup point (where applicable), and a valid contact email to which we will send the confirmation.

A booking is considered confirmed only once payment has been authorized and you receive the corresponding confirmation by email. Availability is held subject to completing payment.

Astronomy tours take place at night and outdoors; they may be affected by weather conditions. Suspensions, rescheduling, and refunds due to weather or operational causes are governed by our Cancellation Policy.

6. Prices and payments

Online bookings are charged in US dollars (USD), whatever the passenger's country. Prices include applicable taxes, and the value of your booking is the one displayed at the moment you confirm payment.

If you cannot use our booking system, write to us before the tour and we will offer you payment in Chilean pesos (CLP) by bank transfer or through an electronic payment link. We do not accept cash and do not take payments at the observatory: your seat is only secured by a confirmed booking.

Online payment is processed in the secure gateway of our booking system. AtacamaStargazing does not store or handle your card data. Once the transaction is authorized, you will receive your booking confirmation by email.

If a transaction is rejected by your bank or cancelled during the payment process, no charge is made and the booking is not confirmed.

7. Cancellations and refunds

Cancellations, rescheduling, and refunds are governed in full by our Cancellation Policy, whose deadlines and refund percentages form part of these terms.

8. Customer responsibilities

During the tour, the customer agrees to follow the guide's instructions, respect the safety and environmental-care rules, and arrive at the agreed point and time. Failure to follow the safety rules, or attending under the effect of alcohol or substances that prevent the safe running of the activity, may result in being unable to take part, with no right to a refund.

9. Disclaimer and limitation of liability

To the fullest extent permitted by applicable Chilean law, AtacamaStargazing shall not be liable for damages arising from the use of the website or from circumstances beyond its reasonable control. Nothing in these terms limits or excludes liabilities that cannot be excluded under the law, including those arising from willful misconduct or personal injury.

10. Amendments

AtacamaStargazing may update these Terms and Conditions at any time. The version in force is the one published on this site; continued use of the site or new bookings imply acceptance of the updated version.

11. Governing law

These Terms and Conditions are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the competent courts of Chile, without prejudice to the rights that consumer-protection law grants to customers.
